Justice of the Peace Joan Gower DeChabert was yesterday grilled by defence attorney Keith Scotland, as the murder trial of two men continued in the Port of Spain Third Criminal Court.
Ako Morris and Kerwyn "Fish" Andrews are on trial before Justice Alice Yorke Soo-Hon, charged with the shooting death of Antonio De Freitas-Jacob.
Scotland, who represents Andrews, questioned DeChabert about his client's composure during the recording of a statement.
Asked by Scotland whether Andrews had tears in his eyes, DeChabert said: "I was not told he had tears in his eyes."
Scotland further probed DeChabert on whether the police officers present told Andrews that he may be prosecuted from the evidence (he will give) for murder.
However, DeChabert eluded the question and was told in a firm tone by Justice Yorke Soo-Hon to answer the question put forth.
"No they (officers) never said it in those words, but he was cautioned," DeChabert said.
Earlier in the proceedings, PC Wayne Charles was recalled to the stand and cross-examined by defence attorney Owen Hinds Jr.
State attorneys Kathy-Ann Waterman-Latchoo and Renuka Rambhajan are prosecuting. The matter continues today. De Freitas-Jacob, who was trained in non-violent karate and competed in several competitions, was fatally shot during a robbery attempt by three bandits on Christmas Eve 2002.
At the time of the fatal robbery, De Freitas-Jacob, 19, was in the process of paying his car insurance at Capital Insurance's office at Piccadilly Street, Port of Spain.
De Freitas-Jacob was the son of well-known veteran martial arts expert/teacher Don Jacob.
