$25,000 for false arrest
Court awards man...


FOR being wrongfully arrested and falsely imprisoned, Subhan Nabby will be paid $25,000.

Justice Shaffei Shah, sitting in the San Fernando High Court, agreed that Nabby, of Rochard Road, Barrackpore, should not have spent time in jail after he was arrested 11 years ago.

Nabby had told the court that around 2 p.m. on June 15, 1997, police officers entered his bedroom and arrested him. The following day he was charged by Sgt Persad Balkaran for maliciously wounding Hamilton Innocent and taken before a Princes Town magistrate on June 17. He was granted bail in the matter on June 23.

In January 2001 the charge was dismissed. Nabby maintained his innocence and claimed he was embarrassed by the charges and trial and filed a lawsuit.

On Tuesday, Shah ruled in Nabby's favour that the police had no reasonable grounds to arrest or imprison him. He will be paid $25,000, interest from the date the lawsuit was filed and his legal cost will also be paid.

Nabby was represented by attorneys Kevin Ratiram and Robin Ramoutar.

Josefina Baptiste, instructed by Harran Ramkaransingh, appeared for the defendant.
